“Smooth Movements Logger” Smartphone App Terms of Use

“Smooth Movements Logger” Smartphone App Terms of Use (will be referred to as “the Terms of Use” from hereon) defines the set of articles that people using this app (will be referred to as “users” from hereon) agrees to when using this smartphone application (will be referred to as “this app” from hereon) released by Stack3 Co., Ltd. (will be referred to as “our company” from hereon). If users do not agree to the Terms of Use, they cannot use this app. If a user has downloaded, installed, and used this app, then the user has agreed to the Terms of Use.

• All copyright and rights pertaining to this app belong to our company.
• Users can only use this app for personal use.
• Users must not reproduce, replicate, transfer, alter, or reverse engineer this app's information downloaded onto the user’s smartphone. Users must also not have a third party commit these acts.
• If any claims are sent to the user from our company, the user must immediately stop using this app, and delete this app from the user’s smartphone.

• When deciding to use this app, the user is responsible for determining this app’s accuracy, reliability, safety, and usefulness.
• Any actions taken or consequences that arise from using this app is the user’s own responsibility to bear.
• If any damages are done to our company or to a third party from using the app, the user must bear their own responsibility and burden of providing compensation for such damages.

Our company has the right to pause, suspend, or change the distribution of this app and its services without the consent of or alerting the user.

• Our company, excluding cases of deliberately malicious action or serious negligence on the part of our company, will not bear any responsibility for damages inflicted on the user or damages committed by a third party on the user while using this app.
• Our company is not responsible for explicit or implicit guarantees that there are no issues with the operation or functions of this app. Our company is also not responsible for explicit or implicit guarantees for each user's integrity of usage goals or results of this app, as well as the accuracy, reliability, and the usefulness of the app.
• Our company is not obligated to offer technical support, maintenance, debugging, upgrades, and other services for the users.
• Our company bears no responsibility for any damages inflicted on the users caused by the changes in or temporary or permanent suspension of the contents of this app.

• Our company will follow the privacy policy determined separately by our company when managing personal and user information.

• The validity, interpretation of and implementation of the Terms of Use will comply with Japanese law, and will be interpreted according to Japanese law.
• Any discussions, litigation, and other conflict between our company and the user resulting in legal action will be under agreement of exclusive jurisdiction of the Tokyo Summary Court or Tokyo District Court.

• Our company may change all or a part of this “Smartphone App Terms of Use.” Our company will notify the users of any major changes.
• If the user cannot agree to the Terms of Use after the change, the user must immediately delete this app from their smartphone.
